Welcome to Clapwork. These Terms of Service ("Terms") govern your use of the Clapwork platform, website, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

Clapwork is a trust-first global freelance marketplace that connects clients with skilled freelancers across multiple jurisdictions. We provide escrow payment protection, identity verification, and compliance tools to ensure safe and transparent transactions.

Please read these Terms carefully. If you do not agree with any part of these Terms, you should not use our Platform.

To use Clapwork, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Not have been previously suspended or removed from our Platform

If you are using the Platform on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

To access most features of our Platform, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your login credentials secure and confidential
• Complete identity verification when required

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.

Clapwork provides a marketplace platform that enables:

• Clients to post projects and hire freelancers
• Freelancers to offer services and find work opportunities
• Secure payments through our escrow system
• Communication tools for project collaboration

We are a marketplace facilitator, not a party to agreements between clients and freelancers. Contracts for services are directly between the hiring party and the service provider.

Clapwork charges service fees for using our Platform. Current fees are displayed on our Pricing page. Key payment terms include:

• Client funds are held in escrow until work is approved
• Platform fees are deducted from payments to freelancers
• Currency conversion fees may apply for international transactions
• Withdrawal processing times vary by payment method

You are responsible for any taxes applicable to your use of the Platform. We may provide tax documentation as required by applicable laws.

When using Clapwork, you agree not to:

• Post false, misleading, or fraudulent information
• Engage in harassment, discrimination, or abusive behavior
• Circumvent platform payments or fees
• Violate intellectual property rights of others
• Attempt to manipulate reviews or trust scores
• Use the Platform for illegal activities

We reserve the right to suspend or terminate accounts that violate these conduct standards.

The Clapwork name, logo, and Platform design are our trademarks and intellectual property. Users retain ownership of content they create and share on the Platform.

Work product ownership should be clearly defined in contracts between clients and freelancers. We recommend including intellectual property terms in your project agreements.

We provide dispute resolution services to help resolve disagreements between clients and freelancers. Our process includes:

• Direct communication between parties
• Mediation assistance from our support team
• Final decision on escrow fund release when necessary

For disputes with Clapwork itself, we encourage contacting our support team first. If unresolved, disputes will be handled through binding arbitration in accordance with applicable laws.

Clapwork provides the Platform "as is" and "as available." To the maximum extent permitted by law:

• We do not guarantee uninterrupted or error-free service
• We are not liable for actions of users on the Platform
• Our liability is limited to fees paid to us in the past 12 months

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Clapwork, you consent to our data practices as described in the Privacy Policy.

We comply with applicable data protection laws including GDPR, CCPA, and other regional privacy regulations.

We may update these Terms from time to time. When we make significant changes, we will notify you by email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically for any updates.

You may close your account at any time through your account settings or by contacting support. We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to the Platform or other users.

Upon termination, your right to use the Platform ends. Provisions that should survive termination (such as payment obligations and dispute resolution) will remain in effect.

These Terms are governed by the laws of the jurisdiction where Clapwork is incorporated, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.
